Does the Lemon Law Apply to Used Cars?

Used cars are more likely to be coined a "lemon," but US federal laws only cover new car purchases. There is a large exception to this rule. If the dealer provides a written warranty along with the used model, then some states will apply the Lemon Law and cover the vehicle. Let's look at what the Lemon Law is and how it applies to car buyers in Colorado. Find out how to get the protection you deserve.

New Car Lemon Laws

About 1% of new cars are considered lemons. These vehicles have repeatable and unfixable problems. To combat the problem, states enacted lemon law protection to help the consumer get rid of their defective car. To take advantage of these laws, you must understand what qualifies the vehicle as a lemon and how to file for relief. The car must have a substantial defect that is covered by the warranty and hasn't been repaired despite numerous attempts to try.

Used Car Lemon Laws

New car lemon laws are enacted in every state throughout the country to protect new car shoppers from a poor investment beneath the surface. In some states, used car buyers are also protected, but, unfortunately, Colorado isn't one of those states. As of now, only 6 states have provisions in place for used cars. These states are Rhode Island, New York, New Jersey, Minnesota, Massachusetts and Hawaii.

Used Car Buyers' Rights in Colorado

In Colorado, the new vehicle must have a manufacturer's warranty and defect that impairs the market value and ability to use it. Under this law, the vehicle must have undergone repair for the defect a minimum of four times. It also applies to any vehicle that has been out of service for a total of 30 or more business days during the warranty. Defects such as squeaks or rattles are not covered because these don't impact the market value. Also, any neglect, abuse or modifications void the protection.
